Workshop Barriers to Private Damage
Actions in Europe: Disperse Antitrust Injury and Civil Damage Claims

The European Commission is keen on facilitating the bringing
of antitrust damages claims in the national courts. Private actions
to recover damages for losses incurred from competition law violations
are a vital element of enforcement and have always buttressed US
antitrust. The staggering underdevelopment of private enforcement
in Europe and the feeling that violations abound led policy makers
in Europe to enact substantial reforms. To enable meaningful compensation
of all victims and strengthen deterrence, policy makers suggest
procedural tools to bundle claims, but market developments are often
ahead of the policy debate. Developments in Germany with respect
to assigning, bundling and financing damage claims have seemingly
cut the Gordian knot. Yet only a thorough understanding of the economics
of private damage actions will achieve the broader goals of the
reform agenda.
ENCORE is delighted to present at this workshop three distinguished
speakers who will take the audience behind the scenes of state-of-the-art
private enforcement. Matt Cantor (Constantine Cannon LLP, New York)
will share his expertise in managing large class actions and their
implications for deterrence and compensation. Pierre Bos (BarentsKrans
BV, The Hague) will compare the US experience and the ongoing debate
in the EU about different policy options and the scope for bundling
damage claims. Finally, Ulrich Classen (CDC Holding SA, Brussels)
will show the audience the fast lane to policy-making and present
the market solution to bundling disperse damage claims and pursuing
Europe 's very first consolidated action in the field of antitrust.

On December 7th, the second Fellows and Associates Day
will take place. Like last year ENCORE chose the Grand as the perfect
place for this event. In the course of this fall all ENCORE-fellows

New Fellows
Tommaso Valletti
Tommaso
Valletti has a magna cum laude degree in engineering from Turin
and holds an MSc and a PhD in Economics from the London School of
Economics, where he also taught until 2001. He is Professor of Economics
at Imperial College London, and also Professor of Economics at the
University of Rome "Tor Vergata" (Italy).
Tommaso's main research interests are in industrial economics,
regulation, and telecommunications economics. He is the Editor of
Information Economics & Policy, Associate Editor of
the Journal of Industrial Economics, and on the Advisory
Board of the Journal of Network Industries and Communications
and Strategies. He has published numerous articles in journals
such as the Economic Journal, European Economic Review, International
Journal of Industrial Organization, Journal of Industrial Economics,
Journal of International Economics, and RAND Journal of Economics.
Tommaso Valletti is a member of the panel of academic advisors
to Ofcom, the UK communications regulator. He is also member of
Ofcom Spectrum Advisory Board, and a member of the panel of academic
advisors of the UK Competition Commission. He was a board director
of Consip, the Italian Public Procurement Agency, in 2002-2005.
He has advised numerous bodies, including the European Commission
(economic expert on remedies in mobile telephony - 2003; economic
expert on market definition - 2006), OECD, and the World Bank on
topics such as network interconnection, mobile telephony markets,
and spectrum auctions.
Coming and going ENCORE guest researchers
Francesco Russo
After two years as a guest researcher at ENCORE, Francesco
Russo has left to join the competition law practice of 'Bonelli
Erede & Pappalardo Studio Legale' in Rome. During his stay
with ENCORE, Francesco completed the draft version of the book
'European Commission Decisions on Competition:
Landmark Antitrust and Merger Cases from an Economic Point of View'.
He furthermore organized and chaired the ENCORE workshop 'Pleabargaining
in the EC Competition Law System' last June. Francesco will remain
affiliated with the Amsterdam Center for Law and Economics as a
visiting PhD student.
Martijn Han
Martijn Han will be guest researcher at ENCORE for
three months. Martijn graduated in Econometrics at the Universiteit
van Amsterdam. This Summer, he received his Master's degree from
the Economic School of London (with distinction) and completed an
internship at the UK Competition Commission in London.
Martijn will contribute to ENCORE's workshop 'Barriers to Private
Damage Actions in Europe: Disperse Antitrust Injury and Civil Damage
Claims', as well as participate in ongoing research into the
pass-on of antitrust damages.

European Commission Decisions on
Competition: Landmark Antitrust and Merger Cases from an Economic
Point of View
The project 'European Commission Decisions on Competition:
Landmark Antitrust and Merger Cases from an Economic Point of View',
sponsored by ENCORE and ACLE, has been completed to the stage of
a draft manuscript, published as ACLE working paper at SSRN.
The book will not be made available electronically. Fellows and
associates can request a hardcopy of the 500 page manuscript for
commenting. Corresponding author is Maarten Pieter Schinkel, at
m.p.schinkel@uva.nl.

ENCORE Summer School Principles
The ENCORE Principles Summer School, held in the beginning
of July 2007, was again a success. Under the supervision of prof.
Jeroen Hinloopen and prof. Jules Theeuwes, 12 participants from
different backgrounds studied the principles of market power, competition
and regulation.

Plea bargaining in the EC Competition Law System
The European Commission currently discusses the introduction
of procedural instruments of direct settlements in European Competition
Law Enforcement. The envisaged system is inspired by what in the
US is known as plea bargaining, yet takes into due consideration
the substantial and procedural differences between the two legal
systems. The reforms are aimed at enhancing quick and efficient
enforcement of EC Competition Law, based on experiences in US antitrust
enforcement.
In this workshop, the contours and various implications of introducing
plea bargaining-type instruments in Europe were discussed by Ewoud
Sakkers (Head of Unit within the directorate F (cartels) at DG Competition
of the European Commission) and Martijn Snoep (partner at De Brauw
Blackstone Westbroek).

Research and Education Day
ENCORE has initiated a covering organization named studIO,
for both Dutch and Belgian students who take a specific interest
in Industrial Organization (IO).
In order to give birth to studIO, ENCORE organized Studio's first
activity: the Research & Education Day 2007. For this conference
on June 15, students from the Netherlands and Flanders were invited
to come and listen to interesting speakers.

Master Class Mike Walker
This specialized and intensive one-and-a-half-day
course concentrated on advanced issues in European competition
law enforcement. The course covered a number of topics currently
hotly debated in Europe, such as issues on the effect of the new
merger standard, Article 82, vertical mergers, the use of empirical
analysis in competition cases, and methods to assess damages in
private litigation. Coverage was self-contained and based on
Dr. Walker's experience as one of Europe's leading competition consultants.
